1. General information

The website www.creative-bright.com is operated by Creative & Bright S.R.L., a limited liability company, registered with the Romanian Trade Register under no. J40/11538/2012, unique registration code (CUI) RO30759194, registered for VAT purposes, with its registered office at Str. Drumul Opalului, No. 1–43, Bloc Cocor, Staircase D, Ap. 6, Sector 1, Bucharest, Romania.

2. Definitions

• Seller – Creative & Bright S.R.L.
  • Client – any natural person at least 16 years old, or any legal entity, that places an order on the site. For minors under 16, use of the site and submission of data require the consent of parents/legal guardians.
  • Products – any goods or services sold through the online store or via the site.
  • Order – an electronic document acting as a form of communication between the Seller and the Client whereby the Seller undertakes to deliver the products/services, and the Client undertakes to receive them and make payment.

3. Website terms of use

By accessing and using the website, the Client declares that they have read, understood, and fully accepted these Terms and Conditions. Creative & Bright reserves the right to modify, at any time, the structure, content, or functionality of the site, without prior notice.

The Client undertakes to:
• provide real, accurate, and complete data when filling in forms;
• not submit illegal, defamatory, threatening, or harmful content;
• not interfere with the security or proper operation of the site.

4. Products and services

4.1 Physical and digital products

Creative & Bright sells both physical products (e.g., journals, educational games, kits) and digital products (e.g., personalized PDF files, course materials, online access to trainings).

4.2 Personalized products

• Processing of the order starts only after full payment.
  • The Client is responsible for the accuracy of the data provided for personalization.
  • Personalized products cannot be returned, according to Government Emergency Ordinance (GEO) no. 34/2014, art. 16(c), except where the items are delivered defective or non-conforming, in which case consumer protection legislation applies.

4.3 Digital content & digital services (GEO no. 141/2021)

For digital content/digital services, Creative & Bright ensures conformity and, where applicable, provides updates (including security updates) within a reasonable period, relative to their nature and purpose. In case of non-conformity, the legal remedies apply (bringing into conformity, price reduction, or termination of the contract).

5. Placing orders and payment

5.1 Placing an order

• Orders are placed online at www.creative-bright.com by completing the checkout form and accepting these Terms and Conditions. By clicking the payment button, you confirm: (i) acceptance of the Terms and Conditions; (ii) acknowledgement of the Privacy Policy; and (iii) your cookie preferences.
  • For digital content, you must separately confirm your consent to start delivery and acknowledge loss of the right of withdrawal, where applicable.
  • The automated order-receipt email confirms that we have received your request, but does not constitute acceptance. The contract is concluded when the Seller expressly accepts the order (confirmation email) and, as applicable, after the payment is authorized.

5.2 Payment methods

• Bank card (Visa/Mastercard) – payments are processed by NETOPIA Payments (mobilPay) on a secure page. Creative & Bright S.R.L. does not collect or store card details; these are processed exclusively by the payment processor. Transactions may use 3-D Secure authentication.
  • Bank transfer – payment details are shown at checkout/in the confirmation email. The order is processed after the amount is credited to our account.
  • Other methods available on the checkout page may be offered from time to time; specific conditions are shown at checkout.

5.3 Payment security

• Connections are protected by security protocols (SSL/TLS). The payment processor implements anti-fraud and card-data tokenization measures. In case of suspected fraud, we reserve the right to request additional verification or cancel the order with notice to the client.

5.4 Prices, currency, and invoices

• Prices are shown in RON and, where applicable, in EUR, and include VAT unless otherwise stated.
  • If you pay in a currency different from your bank account’s currency, differences may arise due to exchange rates and/or bank fees.
  • A tax invoice is issued electronically and sent to the email address associated with the order.

5.5 Unfinished orders / failed payments

• If a card payment is not authorized or the bank transfer is not received within the indicated term, the order may be canceled automatically. You may place a new order or choose another payment method.

5.6 Personalized products and services

• For personalized products/services, production starts only after payment confirmation and, where applicable, after approval of the artwork/mock-up sent by the client. Without such confirmation/approval, delivery timelines will be postponed accordingly.

5.7 Refunds

• If an accepted order is canceled or cannot be honored, amounts paid will be refunded using the same payment instrument used initially (e.g., via NETOPIA Payments for card payments), within the time limits set by law and our policies (typically up to 14 days). The time for the refund to appear on your statement depends on the issuing bank.

6. Delivery

Delivery of products and services is provided in the Delivery Policy published separately on the site.
• For physical products, delivery is made through courier partners; the personal data necessary for shipping is shared with them strictly to provide the courier service. Unless otherwise agreed, delivery is performed within 30 calendar days from contract conclusion (GEO 34/2014). Risk in the products passes to the consumer when they, or a third party indicated by them other than the carrier, take physical possession of the products.
• For digital products, delivery is by email or download link.
• For digital content not supplied on a tangible medium, delivery begins only after your express consent to start performance and confirmation of loss of the right of withdrawal (art. 16(m) GEO 34/2014; GEO 141/2021).

6.1 Transfer of risk and title

Risk in the products passes to the consumer when they, or a third party indicated by them (other than the carrier), take physical possession of the products. Title transfers upon full payment and delivery.

7. Return policy

Returns and the exercise of the right of withdrawal are governed by the Return Policy published separately on the website, following GEO no. 34/2014.

8. Warranty and complaints

Products are covered by the legal guarantee of conformity under GEO no. 140/2021.
• Consumables – no commercial warranty (e.g., stationery, journals).
• Reusable goods – 24-month commercial warranty for manufacturing defects, valid only if the product is used according to the instructions.
For digital content/digital services, GEO no. 141/2021 on conformity and, where applicable, updates, applies.

9. Intellectual property rights

All materials published on or made available through the website (texts, images, layouts, digital files, course materials, audio-video recordings, trademarks, and graphic elements) are the property of Creative & Bright or are used under license.
• Courses and digital materials are licensed for personal, non-exclusive, non-transferable use only.
• Copying, distributing, publishing, modifying, sublicensing, selling, renting, or using the materials for commercial purposes without Creative & Bright’s prior written consent is prohibited.
• Any unauthorized use may entail civil and/or criminal liability under applicable law.

10. User-generated content (UGC) and moderation

Where the site allows reviews/comments, we reserve the right to moderate and/or remove content that violates the law or site rules (e.g., offensive language, third-party personal data, covert advertising, misleading information).

11. Limitation of liability

Creative & Bright S.R.L. is not liable for:
• typographical errors or omissions in site content;
• temporary unavailability of the platform;
• misunderstandings regarding product compatibility with the Client’s needs.

To the extent permitted by law, our total liability to the Client for any direct damages is limited to the amount paid for the order in question.

12. Force majeure

Creative & Bright S.R.L. cannot be held liable for failure to perform contractual obligations caused by force majeure events (natural disasters, pandemics, wars, strikes, acts of authorities, etc.).

13. Disputes and applicable law

These Terms are governed by Romanian law. Disputes will be settled amicably, and failing agreement, by the competent courts in Bucharest. Consumers may contact the National Authority for Consumer Protection (ANPC) and/or Alternative Dispute Resolution (ADR) entities and may also use the European Commission’s Online Dispute Resolution (ODR) platform.

14. Final provisions

Creative & Bright S.R.L. reserves the right to amend this document, with the updated version published on the site. Any change applies only to orders placed after the new version is published. If any clause is declared null, the remaining clauses remain valid (severability).
