- General Provisions
This Delivery Policy sets out how Creative & Bright S.R.L. (“we”, “us”, “our”) delivers products and services purchased via www.creative-bright.com.
Delivery may be:
- Physical – for tangible products and, where applicable, certain offline courses;
- Digital – for items supplied electronically (e.g., personalized PDF files, course materials) and for online courses.
To ensure delivery of physical products, the personal data required for shipping (name, address, phone, email) are shared exclusively for courier services with DPD Romania (and/or other couriers listed below) as processors pursuant to Art. 28 GDPR.
If the Terms & Conditions specify different delivery rules for a particular product/service (e.g., special deadlines or conditions), those provisions prevail.
- Delivery Areas
2.1. Romania. Physical products are delivered throughout Romania via DPD Romania (main partner).
2.2. International. We deliver to all EU member states and, where applicable, to non-EU countries (e.g., Switzerland, Norway, United Kingdom, UAE) via the DPD partner network. The customer is responsible for customs duties, import VAT, fees, and local formalities, where applicable.
For international orders, delivery is generally made under Incoterms® DAP (Delivered At Place): customs duties/import VAT are payable by the recipient.
- Delivery Times
3.1. Legal maximum term. Unless otherwise agreed, physical products are delivered within 30 calendar days from the conclusion of the contract (GEO no. 34/2014).
3.2. Operational estimates (shown on the website).
- Romania: 2–5 business days from payment confirmation (DPD).
- International: 5–15 business days, depending on destination and customs procedures.
- Personalized products: lead times run from the client’s approval of the artwork/layout.
3.3. Digital products.
- Delivered by email or download link within 24–48 hours of payment confirmation.
- Personalized digital products: 1–3 business days, depending on complexity.
3.4. Courses.
- Online (live): access link and instructions are sent by email at least 24 hours before the start time.
- Offline: logistical details are sent by email after participation is confirmed.
Delivery times may be affected by external factors (weather, public holidays, logistics bottlenecks, customs). We will inform you without undue delay and propose rescheduling or a refund, as appropriate.
- Delivery Methods
- Express courier – DPD Romania (primary) plus international deliveries via its partner network.
- Other couriers (e.g., Fan Courier, DHL, TNT) may be used depending on destination or exceptional circumstances, with prior notice to the customer.
- Local pick-up – from our business address (Șos. Pipera 50A, Bucharest) by appointment only; ID/proxy may be required.
- Email / download link – for digital products and course materials.
We do not deliver to PO boxes/parcel lockers unless explicitly offered at checkout.
- Delivery Costs and Currency
- The delivery cost is clearly shown at checkout before order completion and varies by destination and weight/volume.
- For Romania, a fixed cost may appear in the cart (subject to weight/volume/add-on services).
- For international orders, the cost may exclude customs duties/import VAT/other local charges—borne by the customer.
- Currency: payment can be made in RON or EUR (EUR recommended for international orders).
- Digital products: free delivery.
- Courses: any delivery cost for physical materials (if applicable) is included in the participation fee or communicated separately.
- Special Conditions & Responsibilities
- Damaged parcel on receipt: check the packaging upon delivery. For visible damage, ask the courier to draw up a damage report and refuse the parcel after taking photos; notify us in writing within 48 hours at office@creative-bright.com.
- Incomplete/incorrect addresses/recipient unavailable: if delivery fails due to customer-attributable reasons, reshipment will occur after data correction and prepayment of new shipping costs; courier storage/re-delivery fees may apply to the customer.
- Partial delivery: if your order contains items with different lead times, we may ship partially (at no extra cost) or ship in one go when all items are ready—your option will be communicated in advance.
- Transfer of risk: risk of loss/damage transfers when you or a third party indicated by you (other than the carrier) physically receives the products. If you choose your own courier (not offered by us), risk transfers upon handover to your courier.
- Transfer of title: occurs upon full payment.
- Proof of delivery: the AWB, courier delivery confirmation, or electronic receipt confirmation (for digital items) constitutes proof that delivery obligations were fulfilled.
- Non-receipt claims: for parcels marked “delivered” by the courier, claims of non-receipt must be submitted within 5 business days of the “delivered” status so that we can open a courier investigation.
- Digital links: links may expire for security reasons; if so, we will reissue access after verifying payment/identity. Please also check Spam/Promotions folders.
- Updates for digital content/services: where required to ensure compliance, we will provide necessary updates (including security updates) for a reasonable period, considering the nature/purpose of the content (GEO no. 141/2021).
- Delays, Impossibility of Delivery, and Remedies
We make every effort to meet the stated timelines; however, external factors (weather, customs, traffic, etc.) may cause delays.
- If we cannot deliver within the 30-day legal term and you do not accept a new date, you have the right to terminate the contract; we will refund all amounts paid without undue delay (generally within 14 days).
- If delivery is impossible for reasons beyond our control (e.g., repeated refusal, non-existent address), the order may be canceled after notice; shipping/handling fees may be retained.
- Delivery Conformity & Non-Conformities
- If the delivered product does not match the order or is damaged in transit, notify us within 48 hours at office@creative-bright.com (attach photos/documents where applicable).
- We will provide, at no cost to the consumer, repair or replacement, price reduction, or contract termination, under GEO no. 140/2021 (goods) and GEO no. 141/2021 (digital content/services).
- Related transport costs to remedy the non-conformity are borne by Creative & Bright.
- Force Majeure
We are not liable for delays or failure to deliver caused by force majeure (natural disasters, pandemics, strikes, armed conflicts, acts of authorities, etc.).
